Advertiser Terms and Conditions
Definitions:
For the purpose of these Terms and Conditions the term “advertiser” refers to any individual or third party acting on behalf of that individual submitting an advertisement for inclusion on the Origin Sports website.
The term “advertisement” refers to any copy, imagery or content supplied by the advertiser for inclusion on the Origin Sports website.
The term “website” refers to any of the websites operated by Origin Sports.
General Advertiser Terms and Conditions:
1. Origin Sports reserves the right to refuse, amend, withdraw or otherwise deal with all advertisements submitted at its discretion.
2. All advertisements must be legal, decent, honest and truthful and comply with the British Code of Advertising Practice and all other relevant codes under the general supervision of the Advertising Standards Authority and must in no way contravene the Trade Descriptions Act.
3. The advertiser warrants that:
(a) The reproduction and/or publication of the advertisement by Origin Sports as originally submitted or as amended pursuant to clause 1 will not breach any contract or infringe or violate any copyright, trademark or any other personal or proprietary right of any person or render Origin Sports liable to any proceedings whatsoever.
(b) In respect of any advertisement submitted which contains the name or pictorial representation (photographic or otherwise) of any living person and/or any part of any living person and/or any copy by which any living person is or can be identified the advertiser has obtained the authority of such living person to make use of such name, representation and/or copy.
(c) All advertising copy submitted to Origin Sports is legal, decent, honest and truthful and complies.
(d) It will be fully responsible for the terms (including, without limitation, product description, price and compliance with all applicable laws and regulations) of any contract for the sale of goods or services to customers who have seen the advertisement displayed by Origin Sports.
4. The advertiser shall indemnify Origin Sports in respect of costs, damages or other charges suffered or incurred as a result of legal actions or threatened legal actions arising from the publication of the advertisement published in accordance with the copy instructions supplied to Origin Sports by the advertiser.
5. Origin Sports, or agents acting on its behalf, will not be liable for any loss or damage, consequential or otherwise occasioned by error, late publication or the failure of an advertisement to appear from any cause whatsoever.
6. Origin Sports will not be liable for any claim whatsoever in respect of legislation in connection with the European Community Package Travel Directive. Origin Sports features advertisements in good faith but cannot assume any responsibility in respect of individual package organisers or retailers.
7. The advertiser is ultimately responsible for checking the website to verify the accuracy of their web adverts.
8. Advertisers are given the option to upload their own content onto their entry on the website, however, advertisers may request that Origin Sports enters content and images onto their web page advertisement on their behalf. Origin Sports reserves the right to make an additional charge to the advertiser if entering content and images on their behalf and the total charge will be made clear to the advertiser before work commences on the advertisement.
9. Any significant costs incurred by Origin Sports in making amendments to advertisers’ entries, including authors’ corrections, will be recharged to the advertiser. These charges will be made known to the advertiser before work commences on the advertisement.
10. The financial liability of placing this advert remains with the advertiser should the establishment be sold to a third party.
11. The contents of the website are available to any user and/or visitor for personal reference only and may not be reproduced in any manner whatsoever either in whole or in part without the prior written permission of Origin Sports, its authorised agents or representatives.
12. The use of the website is at the visitor’s or user’s own personal risk. Origin Sports does not warrant the content, accuracy or veracity of any material or other information on the website nor does it warrant that the website is free from errors, faults, viruses or other computer or data-corrupting or data-damaging material.
13. Origin Sports makes no guarantee of revenue to the advertiser as a result of placing any such web advert.
14. Descriptions of, or references to, products, services or publications within the website do not constitute or imply
their endorsement or recommendation in any way by Origin Sports, its employees or contractors.
15. Advertisers may place adverts for more than one property. However, the total number of properties being advertised per advertiser will be at the discretion of Origin Sports.
16. The advertiser is required to make payment to Origin Sports using the stated payment method prior to any advert appearing on the website unless a free advertising offer is being operated at the time of sign up as detailed below.
17. Origin Sports reserves the right to cancel any advertising in the event of the advertiser being in default of payment or any charges due in breach of these Conditions. Origin Sports reserves the right to charge interest on any amounts due beyond the credit limit of 30 day at the rate of 4% above the Bank Rate prevailing at the time of indebtedness.
18. Refunds will not be given if an advertiser chooses to cancel their advertisement at any time after payment has been made.
19. These terms and conditions shall be governed and construed in accordance with the Laws of England and the parties hereby submit to the non-exclusive jurisdiction of the Courts of Law of England in respect of any dispute or matter arising out of or connected with these terms and conditions.
20. Free advertising: Origin Sports may from time to time offer free advertising on the website. Advertisers will be informed of the end date of the free advertising period prior to the submission of their details. At the end of the free advertising period advertisers will be informed of the cost of continuing their presence on the site and will be given the option to cancel their advertisement at no cost. Advertisers may upload details for more than one property during a free advertising period, however, the total number of properties being advertised per advertiser will be set at the discretion of Origin Sports.
